Terms of Service
Last updated: 28 October 2026
1. Who we are and what these terms cover
akap is an online service run by Pasifik Cloud Solutions Pty Ltd (ABN 35 627 754 821, ACN 627 754 821) ("Pasifik Cloud", "we", "us").
These terms apply when you use akap at akap.cloud. That includes the customer portal, the eligibility application form and the Licence Health Check.
If you buy Microsoft products or services from us, or use the Licence Health Check, the akap Managed Service Terms also apply. Section 15 explains which document applies if they conflict.
2. Who can use akap
akap is for organisations, not personal use. You may use it only:
- for your organisation, and
- if you are authorised to act for it.
If you accept these terms for an organisation, you confirm you can bind it. "You" means you and that organisation.
3. Your account
- You sign in with your Microsoft 365 work account. We do not see or store your password.
- The first time you sign in, akap creates your user profile. You can see an organisation's account only after you have been given access to it.
- Keep your sign-in details secure. Tell us promptly if you think someone has used your account without permission.
- Your organisation's administrators control who can use your organisation's account and what they can do.
- You are responsible for activity under your organisation's account, except where we caused it.
4. Using akap properly
You must not:
- use akap to break the law or anyone else's rights
- try to access accounts, data or systems you aren't allowed to access
- interfere with akap, overload it, or test its security without our written permission
- copy, resell or reverse-engineer akap, except where the law allows it
- upload malicious code, or content you don't have the right to share
- give false or misleading information, including in an eligibility application
We may suspend or limit access if we reasonably believe you have broken these terms, or put akap, other customers or Microsoft's systems at risk. Where it is reasonable to do so, we will tell you first.
5. Information shown in akap
akap shows information from our records and from Microsoft, such as subscriptions, licence counts, invoices and reports. We aim to keep it accurate, but it can sometimes be delayed or incomplete.
If akap differs from your invoice, quote or signed agreement, the invoice, quote or agreement applies.
6. Microsoft products and terms
Microsoft provides Microsoft products. Your use of them is governed by the Microsoft Customer Agreement and the other Microsoft terms you accept. Microsoft is not a party to these terms.
7. Quotes, orders and payment
Your quote or invoice shows the prices, currency, GST and payment terms.
Where akap offers them, you can pay by:
- card
- direct debit
- bank transfer
Card and direct debit payments are processed by our payment provider. We do not store your full card number.
Platform plans. An akap platform plan is a paid plan for using akap itself. If your organisation subscribes to one:
- our payment provider keeps your card or direct debit details on file and charges each renewal monthly or annually, as shown when you subscribed, at the price shown then or any new price we have told you about under the next point
- we'll tell you by email at least 30 days before a price change applies to your next renewal
- you can cancel at any time to stop future charges by emailing contact@pasifikcloud.com
- if you cancel, your plan continues until the end of the period you have paid for, and then stops. We don't refund the rest of that period, except where the law requires it or we agree otherwise in writing.
The akap Managed Service Terms have more detail.
8. Intellectual property
We, or our licensors, own akap and its content. While you comply with these terms, you may use akap for your organisation's internal business purposes.
You keep ownership of the information you give us. You allow us to use it to provide akap and our services, as our Privacy Policy describes.
9. Australian Consumer Law
Nothing in these terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law, or any other law, that cannot lawfully be excluded, restricted or changed.
Where the law allows us to limit our liability for failing to meet a consumer guarantee, we limit it, at our option, to:
- supplying the services again, or
- paying the cost of having them supplied again.
10. Our liability
Section 9 applies first. Subject to it:
- We aim to keep akap available and accurate, but we can't promise it will be uninterrupted or error-free.
- Neither of us is liable to the other for indirect or consequential loss.
- We are not liable for loss to the extent it is caused by:
- Microsoft
- services outside our control
- your own systems, or things you or your administrators do
- Our total liability arising out of or in connection with akap is limited to the total fees you paid us for akap in the 12 months before the event that gave rise to the claim.
None of these limits applies to loss caused by our negligence, wilful misconduct or fraud, or by our breach of our privacy obligations.
11. Your responsibility for misuse
You are responsible for loss we suffer because you misuse akap, break these terms or give us false information. This does not apply to the extent we caused the loss.
12. Ending your use
You can stop using akap at any time. Stopping does not by itself cancel your Microsoft subscriptions. The akap Managed Service Terms explain how cancellation works.
We may suspend or close an account:
- under section 4, or
- if amounts are overdue and remain unpaid 14 days after we have sent you a reminder.
Sections on payment, liability and intellectual property still apply after an account closes.
13. Changes to these terms
We may update these terms. When we do, we will post the new version on this page with a new date.
If a change materially affects you, we will tell you by email or in akap at least 30 days before it takes effect. If the change is to your detriment, you can stop using akap before then without penalty. You still have to honour your Microsoft subscription commitments.
14. Disputes and governing law
If you have a dispute with us, please contact us first so we can try to resolve it.
These terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales, and of the courts that can hear appeals from them.
15. Which document applies
If documents conflict, they apply in this order:
- a signed agreement between you and us
- your quote, for the order it covers
- the akap Managed Service Terms, for managed services
- these terms
